ERA - Upcoming Conferences


ACADÉMIE DE DROIT EUROPÉEN - ACADEMY OF EUROPEAN LAW - EUROPÄISCHE RECHTSAKADEMIE - ACCADEMIA DI DIRITTO EUROPEO (ERA):

-Conference 'Collective Redress. Towards a system of class actions in Europe?' (Florence, 30-31 Oct 2008). The practice of taking collective actions is clearly developing in Europe, particularly in the areas of consumer protection, product liability, discrimination, environmental pollution and litigation arising from certain capital markets transactions. Several European jurisdictions have either implemented legislation that makes it easier for claimants to bring group or class actions, or are considering implementing legislation, especially in the consumer protection context.
This conference will look at recent developments in a number of European jurisdictions (e.g. France, Germany, Italy, Sweden, United Kingdom) and it will present complex case-law (e.g. Deutsche Telekom, Parmalat). The success and failure of certain national rules will be analysed.
Developments at European level will form an important part of this conference as the European Commission and the European Parliament are actively pursuing plans to facilitate court actions by collective groups.

-Conference '3rd Forum on EU Immigration and Asylum Policy' (Barcelona, 13-14 Nov 2008). Over the last decade immigration and asylum have been key elements of the European Union’s common approach to justice and home affairs as defined and developed in the programmes adopted at Tampere in 1999 and the Hague in 2004.
This seminar will look at the challenges presented by legal instruments in this field. It will discuss the global approach to migration, which aims to formulate comprehensive and coherent policies - including external relations, employment and justice, freedom and security - that address the broad range of migration-related issues. The recent Commission communications on the creation of a border surveillance system (Eurosur), on boosting operational coordination between Member States through Frontex and on the possibility of a “Registered Traveller Programme” will be discussed.
The continuing attempts to set up a common asylum policy acceptable to all EU member states will also be examined, as will the evaluation report on the Dublin system and the proposal for a directive to extend long-term residence status to beneficiaries of international protection.
Whilst looking mainly to the future, the seminar will also review the achievements of EU immigration and asylum policy since Tampere and the Hague from a legal perspective. The present seminar follows the pattern of the first two forums organised by ERA in 2005 (Rome) and 2007 (Milan).

-Conference 'Cross-Border Enforcement in European Civil Procedure. European Payment Order, European Small Claims Procedure and European Enforcement Order (Trier, 24-25 Nov 2008). The purpose of this conference is to introduce the recent legal acts
and to provide an in-depth analysis of these instruments.
The Regulations are intended to be an important step forward in ensuring the free circulation of judgments within the EU. Under certain conditions, the exequatur procedures between Member States will be eliminated, enabling creditors to obtain quick and efficient enforcement abroad. However, the Regulations raise a number of questions, especially regarding the debtor’s rights of defence.
