ERA - Upcoming Conferences (February 2010)


ACADÉMIE DE DROIT EUROPÉEN - ACADEMY OF EUROPEAN LAW - EUROPÄISCHE RECHTSAKADEMIE - ACCADEMIA DI DIRITTO EUROPEO (ERA):

-Annual Conference on European Insurance Law 2010. Focus on cross-border insurance contracts (Trier, 8 February 2010 – 9 February 2010): This conference will provide an overview of current issues and future challenges in European insurance law, as well as a forum for discussion between legal practitioners active in the sector.
The conference's main focus will be the cross-border insurance contract. The law governing the contract as well as the main issues arising before, during and after its conclusion will be analysed by experts in the field in the light of recent developments in legislation and jurisprudence.
Further measures directed to the more efficient protection of the policyholder and likely to significantly influence the insurance sector in the aftermath of the financial crisis will be addressed:
  • The harmonisation of insurance guarantee schemes
  • The Green Paper on consumer collective redress
  • Legal insurance in the light of the Eschig case (C-199/08)
  • Solvency II after the adoption of the Framework Directive

-Cross-border Successions. The new Commission proposal: contents and way forward (Trier, 18 February 2010 – 19 February 2010): This conference will focus on the law relating to the estimated 450 000 successions with a cross-border dimension, with a combined value of EUR 123 billion, that take place each year in the EU.
On 14 October 2009, the European Commission published its long-awaited proposal for a Regulation on jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of succession and the creation of a European Certificate of Succession (COM (2009) 154), which aims to help settle international successions involving people living in the EU.
The idea is to provide participants with an in-depth analysis of the possible future European instrument on successions. The objective of the conference is to promote a far-reaching and thorough debate concerning the most important or complex issues inherent to cross-border successions upon death.
The following most topical issues will be on the agenda:
  • Scope of the instrument and the exclusion of property rights/trusts
  • Freedom to testate of forced heirship?
  • Drafting testamentary dispositions, joint wills and agreements as to succession
  • Which court is competent to decide cross-border succession cases?
  • Scope of the applicable law, including administration and distribution of the estate
  • The impact of matrimonial property and the lex rei sitae on inheritance law
  • Recognition and enforcement of decisions and authentic documents
  • Creation, contents and effects of the European Certificate of Succession

-Using EU Criminal Justice Instruments. Mutual legal assistance and mutual recognition of judicial decisions in the EU (Advanced seminar for judges and prosecutors from Cyprus, Greece, Ireland, Malta, Spain, Portugal and the UK) (Lisbon, 18 February 2010 – 19 February 2010): This seminar is part of a decentralised series offering in-depth training in the practical use of EU instruments on mutual legal assistance and mutual recognition of judicial decisions in criminal matters. One specific aim of the series is to train groups from selected EU Member States which are geographically close to each other and therefore connected in terms of cross-border cooperation.
The seminar will address judges and prosecutors from Cyprus, Greece, Ireland, Malta, Spain, Portugal and the UK who have already gained significant practical experience in cross-border judicial cooperation and in applying EU mutual recognition instruments.
By means of case studies, participants will learn about the practical questions that arise under their own legal system and moreover, under the systems of their colleagues in other member states when executing a European Arrest Warrant, freezing order or confiscation order, exchanging evidence and criminal records. The new competences of Eurojust, particularly regarding Joint Investigation Teams, will be outlined. Finally, time will be devoted to present and debate forthcoming mutual recognition instruments and instruments envisaged under the Stockholm programme such as the Framework Decision on taking account of convictions, the extension of the European Evidence Warrant and the changes that the Lisbon Treaty will bring to the field of European criminal justice.
The seminar will be coordinated by national and European experts. An introductory e-learning course will be offered.

-Annual Conference on European Antitrust Law 2010. Focus on EU case law and Commission decisions (Trier, 22 February 2010 – 23 February 2010): The conference will discuss the latest and most significant developments, with a particular focus on the case law of the Court of Justice of the EU and recent decisions from the European Commission on:
  • Article 101 TFEU (former Article 81 EC), inter alia, the concept of concerted practice (e.g. T-Mobile), the assessment of a restriction by object (e.g. GSK), as well as related issues, such as the imputability of infringements within groups of undertakings (e.g. AKZO Nobel);
  • Article 102 TFEU (former Article 82 EC), focusing on predatory pricing (e.g. France Télécom), rebate schemes, standard settings;
  • Mergers, including the issue of the non-contractual liability of the Community on account of the illegality found (e.g. Schneider).
The conference will also analyse policy developments under Article 101, 102 TFEU and mergers, including the new block exemption regime, enforcement priorities in relation to abusive exclusionary conduct, and the guidelines on non-horizontal mergers, alongside an assessment of the role of the European Commission as amicus curiae and the role of the Hearing Officer.

-Intellectual Property and the Information Society in the EU. Conference organised by the Friends of ERA in cooperation with ERA and the Autonomous University of Barcelona (Barcelona, 26 February 2010): Today's global information society and the rapid pace of technological developments characterised by works capable of being digitised, transmitted and reproduced instantaneously by broadcasting, cabling or over computer networks is posing significant challenges for intellectual property rights holders, consumers and policymakers. Modern intellectual property law faces new issues related to the conflict between several fundamental rights such as access to education, freedom of expression and the right of privacy. The advent of modern technologies that recognise no national boundaries requires clear rules on applicable law and effective enforcement measures.
This one-day conference will give the opportunity to look at how the European Union through its policies, legislation and case law is tackling emerging intellectual property issues in the field of competition law, collective management of copyright and right of privacy. New EU initiatives related to the impact of copyright on education and research in the knowledge economy and the pan-European licensing of music rights will also be discussed.
